Linguistik Forensik dalam Penanganan Plagiarisme Akademik: Analisis Komprehensif Berbasis Hukum Nasional dan Maqashid Syariah

Abstrak

Modernisasi sistem informasi telah mempermudah akses terhadap pengetahuan. Namun, fenomena ini juga meningkatkan kompleksitas permasalahan plagiarisme akademik. Artikel ini bertujuan untuk mengeksplorasi peran linguistik forensik dalam proses deteksi dan pembuktian plagiarisme, dengan mempertimbangkan perspektif hukum nasional Indonesia dan maqashid syariah. Penelitian dilakukan melalui studi pustaka kualitatif dengan menganalisis 50 dokumen yang relevan. Hasil analisis menunjukkan bahwa linguistik forensik efektif dalam mengidentifikasi finger print, linguistik penulis, pola argumentasi, serta jejak intertekstualitas yang sering tersembunyi dalam praktik plagiarisme. Pendekatan ini mampu mengungkap ciri khas stilistika, mendeteksi anomali sintaksis, dan memetakan pola argumentatif di balik parafrase manipulatif maupun mosaic plagiarism. Secara teknis, dalam perspektif hukum nasional, instrumen normatif seperti seperti Undang-Undang Hak Cipta, Undang-Undang tentang Informasi dan Transaksi Elektronik (ITE), Kitab Undang-Undang Hukum Perdata, serta undang-undang Kementerian Pendidikan Nasional memberikan rangkaian pembenaran hukum untuk penuntutan plagiarisme meskipun banyak hambatan baik secara institusional maupun teknis. Di sisi lain, maqashid syariah menganggap plagiarisme sebagai pelanggaran terhadap amanatul ‘ilm (kepercayaan pengetahuan) yang melanggar pelestarian atau defisit intelektual serta modal fiskal dan kredit moral. Integrasi antara pendekatan linguistik forensik, sistem hukum positif, dan maqashid syariah membentuk kerangka komprehensif yang tidak sekedar menegakkan keadilan normatif, tetapi juga memastikan pemeliharaan integritas moral dan spiritual dalam dunia akademik. Penelitian ini berkontribusi dalam memperkuat budaya integritas ilmiah di Indonesia.
